General Terms and Conditions
These General Terms and Conditions (GTC) apply to all services provided by Haute Lumière Photographie – Sauthier Anouchka to private individuals and professional clients.
They supplement the conditions specified in the quotation. In the event of any conflict, the specific provisions stated in the quotation accepted by the Client shall prevail.
1. Services and Booking
Haute Lumière Photographie provides photography services including individual, couple and family sessions, portraits, event photography, as well as services for businesses, communication purposes and social media.
Each service is subject to a quotation specifying, in particular, the scope of the service, the price, any optional services and, where applicable, the usage rights granted to the Client.
Unless otherwise stated, a quotation is valid for 30 days from its date of issue.
A booking becomes final once the quotation has been accepted and, where a deposit is required, once the deposit has been received.
Acceptance of a quotation or booking of a service implies full acceptance of these General Terms and Conditions.
2. Prices and Payment
Prices are stated in Swiss francs (CHF), unless otherwise specified. The applicable price is the one stated in the accepted quotation.
Additional services or costs may be charged if the Client requests extra work, including additional hours or significant changes to the project. Whenever possible, such additional costs will be approved by the Client in advance.
Payment is made by invoice, bank transfer or cash.
Unless otherwise stated in the quotation or invoice, payment is due within 30 days from the invoice date.
A deposit may be required for certain services. The amount and applicable conditions will be specified in the quotation.
In the event of late payment, Haute Lumière Photographie may, after sending a reminder, suspend the delivery of photographs or any additional services until all outstanding amounts have been paid.
3. Performance of the Service
Haute Lumière Photographie undertakes to perform each service with care and professionalism in accordance with the accepted quotation.
The Photographer retains artistic freedom regarding, in particular, framing, lighting, composition, colours, image selection and retouching choices.
The Client acknowledges that photography involves artistic interpretation. Reference images or inspiration provided before a session therefore do not constitute a guarantee that an identical result will be reproduced.
4. Image Selection and Retouching
Unless otherwise agreed, the selection of photographs delivered to the Client is made by the Photographer.
Retouching includes the adjustments necessary to achieve a consistent and harmonious final result. Extensive alterations or specific transformations are not included unless expressly provided for in the quotation.
RAW files and other source files are not provided to the Client unless otherwise agreed in writing.
5. Delivery of Photographs
The usual delivery time is approximately two weeks after the photography session or after completion of the final stage required for the project.
This timeframe is indicative and may be extended for large-scale, professional or event projects, projects involving a significant number of photographs, or projects requiring extensive post-production work.
Photographs are generally delivered via an online gallery or digital download, according to the agreed arrangements.
Once the files have been made available, the Client is responsible for downloading and securely backing them up.
6. Copyright and Use of Photographs
Photographs created by Haute Lumière Photographie remain the intellectual property of Sauthier Anouchka, insofar as they are protected by copyright.
Payment for a photography service does not constitute a general transfer of copyright.
For private clients, the delivered photographs may be used for personal purposes, including personal storage, private printing, sharing with friends and family, and publication on personal social media accounts.
Any commercial, advertising or professional use requires the Photographer’s prior consent or must be expressly provided for in the quotation.
For businesses, usage rights are defined according to the specific project and may specify the authorised media, duration, territory and permitted uses.
Any additional use not included in the original agreement may require further authorisation and may be subject to additional fees.
7. Publication and Modification of Photographs
When publishing photographs on social media, the Client agrees, where permitted by the platform, to credit the Photographer as follows:
© Haute Lumière Photographie – Sauthier Anouchka
Photographs must not be substantially altered without the Photographer’s prior consent.
This includes, in particular, filters that significantly alter the appearance of the image, major colour changes, retouching, the addition or removal of elements, or cropping that distorts the original photograph.
Cropping required to adapt photographs to specific social media formats is permitted provided that it does not distort the original work.
8. Image Rights
The Photographer’s copyright and the image rights of the persons appearing in the photographs are separate rights.
Where required, the Client is responsible for obtaining the consent of the persons they ask to be photographed.
For services provided to businesses, the professional Client is responsible for obtaining any necessary authorisations from employees, collaborators, models, clients or any other persons appearing in the photographs.
For minors, authorisation from their legal representatives must be obtained where required.
9. Cancellation and Rescheduling
Any cancellation must be communicated to Haute Lumière Photographie as soon as possible.
Any financial conditions relating to cancellation are those specified in the quotation. Where no specific conditions have been agreed, costs already incurred and any damages resulting from the cancellation may be claimed within the limits permitted by applicable law.
Where possible, the service may be rescheduled to a new date.
In the event of illness, accident or another circumstance preventing the Photographer from performing the service, a new date will be proposed whenever possible.
For urgent assignments or events, a professional replacement photographer may also be proposed with the Client’s consent.
If neither a replacement nor rescheduling is possible, any amounts already paid for services that have not been performed will be refunded.
10. Confidentiality
Confidential information provided as part of a professional project will only be used to the extent necessary to perform the agreed services, subject to applicable legal obligations.
Photographs relating to a project expressly identified as confidential will not be published in the Haute Lumière Photographie portfolio.
11. Data Protection
Personal data provided by the Client is used only to the extent necessary to manage the contractual relationship, perform the service, issue invoices and, where authorised, for professional communication purposes.
This data may include the Client’s contact details, billing information, project-related information and photographs in which individuals can be identified.
Personal data is processed in accordance with applicable legal requirements and is not sold to third parties.
12. Complaints
Any complaint relating to a service or delivered photographs must be submitted within a reasonable period after receipt.
The Client should describe the issue as precisely as possible so that Haute Lumière Photographie can review the matter and seek an appropriate solution.
13. Applicable Law
These General Terms and Conditions are governed by Swiss law, subject to any mandatory legal provisions that may apply.
They apply to all services ordered from Haute Lumière Photographie from their effective date.
